The City of Saint-Avold, like all structures, has constant needs for its operations, to improve and develop urban development, building construction projects, supplies or various services...
In response to these requests, the City of Saint-Avold is consulting companies with a view to concluding contracts, in accordance with current legislation and in particular :
- Code de la commande publique (in force since April1, 2019),
- The ASAP law of December 08, 2020,
- The Climate and Resilience Act of August 22, 2021,
- The AGEC Act of February 10, 2020,
- The REEN law of November 15, 2021, in particular article 35,
- The Green Industry Act of October 23, 2023,
- the Cahier des Clauses Administratives Générales applicable to public procurement contracts.
Saint-Avold's purchasing policy aims to satisfy the city's needs, in complete legal certainty, in the pursuit of greater efficiency both internally and in the services provided to the population.
This policy focuses on three main areas:
- improve purchasing efficiency
- taking greater account of sustainable development
- encourage access to public procurement for very small businesses, especially SMEs and SMIs.

Are all companies eligible for public procurement contracts?
In principle, access to local public procurement contracts is unrestricted. However, in accordance with articles L. 2141-1 to L. 2141-12 of the French Public Procurement Code, certain persons may be denied access to public procurement contracts. This may apply in particular to :
- convicted of certain criminal offences,
- in receivership,
- who have not fulfilled their tax and social security reporting obligations,
- who have not complied with regulations on concealed or illegal work,
- that have not met their obligation to employ disabled workers.
Can a newly created company bid for a public contract?
Newly-established companies can bid for public contracts without having to prove their financial capacity in previous years. They must produce a certified copy of the filing receipt from the Centre de Formalité des Entreprises to prove their existence. This applies to companies in the process of being registered.
Can a company bid for a reserved contract?
A reserved contract is a contract for which only certain companies may bid. These companies are "entreprises adaptées" or "établissements et services d'aide par le travail" (mentioned in articles L 5213-13, L 5213-18, L 5213-19 and L 5213-22 of the French Labor Code and L 344-2 of the French Social Action and Family Code). The majority of the workers concerned must be disabled people who, due to the nature or severity of their impairments, are unable to work under normal conditions. Thus, right from the advertising stage, companies must be aware that the contracts in question can only be awarded to specific companies. This provision must be included in the advertising notice.

In accordance with current regulations, purchases are made after a genuine competitive bidding process, in which companies are informed of the community's needs.
Public contracts are awarded to the company that submits the most economically advantageous bid, based on criteria defined in the public invitation to tender or in the consultation regulations.
To facilitate companies' access to local public procurement, the City of Saint-Avold wishes to develop information for them using new technologies.

All of the City of Saint-Avold's public procurement consultations are online (with the exception of non-competitive contracts).
As a result, all exchanges must take place electronically:
- offer submission,
- questions and answers,
- negotiations,
- rejects,
- attributions.
Paper deposits are prohibited.

Before responding to a call for tenders, please read carefully the regulations associated with each advertising notice. You'll learn about the main features of the contract, the documents to be produced and the criteria according to which your bid will be analyzed.
Deadline for receipt of bids
On the day of the deadline for receipt of bids in response to a consultation, bids must be submitted electronically on the contracting authority's buyer profile before 5 p.m., at the following URL address: https://www.klekoon.com. Only bids received by the date and time specified in the advertising notice and/or the consultation rules can be opened.
A backup copy may be sent by post or delivered against a receipt to the secretariat of the Direction de la Commande Publique, located at 36, boulevard de Lorraine, 57500 SAINT- AVOLD, from Monday to Thursday, from 8 a.m. to 12 p.m. and from 1.30 p.m. to 5.30 p.m., and on Friday from 8 a.m. to 12 p.m.
This copy must be placed in an envelope marked "copie de sauvegarde", with the candidate's name and the identification of the procedure concerned. It is opened in the following cases:
- when a malicious computer program is detected in the electronically transmitted envelope;
- when the electronic envelope is received incomplete, out of time, or has not been opened, provided that transmission began before the close of bid submission.

We would also like to point out that, pursuant to Article R. 2143-7 of the French Public Procurement Code, the candidate to whom the contract is to be awarded must produce the following documents, failing which his offer will be rejected:
- The documents specified in articles D. 8222-5 or D. 8222-7 and D. 8222-8 of the French Labour Code; these documents must be produced every six months until the end of the contract;
- Attestations and certificates issued by the relevant authorities and organizations proving that it has met its tax and social security obligations.
N.B :
The contract may only be awarded to the candidate whose bid has been accepted if he produces the documents, certificates and attestations specified above within the allotted time. If it is unable to produce these documents within the allotted time, its bid will be rejected and the candidate eliminated.
The candidate whose bid was ranked immediately after his own is asked to produce the necessary certificates and attestations before the contract is awarded to him. If necessary, this procedure may be repeated for as long as there are still bids that have not been rejected as inappropriate, irregular or unacceptable.
The town of Saint-Avold regularly includes a social clause in its contracts. Companies holding the contract commit to a minimum number of working hours reserved for this purpose. Beneficiaries are either recruited directly by the company, or subcontracted through an integration company or a temporary employment agency, whether integration or not.

All companies have been obliged to send their invoices to the State, local authorities and their respective public establishments by dematerialized means since 2020 (order of June 26, 2014).
The call for expressions of interest (AMI) is " an ad hoc procedure not provided for in the public procurement code, enabling a public entity to solicit private initiative to encourage the emergence of projects in which it has an interest, without the need having to be perfectly expressed ".
A call for projects, also known as a "call for expressions of interest", consists in a public authority, with a view to achieving a general interest objective, inviting initiatives from interested third parties, selecting the proposal from these third parties that it considers the most satisfactory and providing support, which may take the form of a subsidy, the transfer of an asset for valuable consideration, the granting of a right to occupy public land or planning permission.
Although it also involves a competitive bidding procedure, the call for projects differs from public procurement contracts in that its purpose is not to meet a public authority's needs in terms of works, supplies or services, or to entrust a third party with the performance of a public service mission, but to select from among projects whose initiative and content are the sole responsibility of their authors the one most appropriate to the general interest objective sought.
It can be used in many areas of public activity, including land development, and is unregulated, except where special provisions apply. When a call for projects results in the awarding of a public domain occupation permit to the selected third party, the prior selection procedure set out in articles L2122-1-1 et seq. of the French General Code of Public Ownership must be followed.
