Commercial right of pre-emption
IMPLEMENTATION OF THE COMMERCIAL RIGHT OF FIRST REFUSAL
By resolution of June 27, 2022, item no. 13, the municipal council decided to introduce a commercial right of first refusal, enabling the commune to acquire priority on sales of :
- goodwill,
- craft funds,
- commercial leases,
- land intended for retail premises with a sales area of between 300 and 1,000 m².

The scope of application of the commercial right of pre-emption is as follows:
Any transfer of these properties within the perimeter of the trade and craft safeguard zone must be subject to a prior declaration (https://entreprendre.service-public.fr/vosdroits/R18601) made by the transferor to the municipality, failing which it will be null and void.
The commune has a period of 2 months from receipt of your declaration of transfer to acquire the property. After this period, silence is tantamount to renunciation of acquisition.
To do this, you can send 2 copies of your declaration of transfer form to the Town Planning/Property Department, either :
- by registered letter with acknowledgement of receipt by handing it in to the relevant department against receipt
- by mail to sce.urbanisme@mairie-saint-avold.fr
If the property is not located within the perimeter, you are free to sell it without having to make any prior declaration.
